Are You Ready? New Consumer Protection Rules Start October 16
If you collect leads or customer inquiries on your web site, you’ll want to ensure that your company is in compliance with the new Telephone Consumer Protection Act guidelines that go into effect on Oct. 16, 2013.
These new rules require you to obtain prior, express written consent for all marketing phone calls or text messages that you send to a cell phone or land line. Consent must consist of an affirmative, opt-in action by the consumer showing that they understand the consequences of their consent; they realize that consent is not a required condition of purchase; and they are voluntarily providing an email address or phone number for further contact. Per the E-SIGN Act passed by Congress, electronic signatures obtained through a website form, text message, email, telephone key press or recorded affirmation are acceptable forms of written consent.
